Rules and guidelines for using our platform

These Terms of Service ("Terms") govern your access to and use of Dopple, the AI-enabled social media management platform operated by Thinkify ("Thinkify," "we," "us," or "our"). By creating an account, connecting social media profiles, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are accepting on behalf of a company or organization, you represent that you have authority to bind that entity. If you do not agree, do not use the Service.
Dopple provides tools to monitor, analyze, and respond to fan interactions across supported social media channels. Core features include:
We may make new functionality available or discontinue features at any time. Certain capabilities may be labeled beta, preview, or experimental and may be subject to additional terms or limitations.
You are responsible for how you and anyone acting on your behalf use the Service. In addition to platform rules of Instagram, Facebook, TikTok, X/Twitter, and other connected services, you agree to:
You must not (a) misuse or overload our infrastructure, (b) attempt to reverse engineer or extract source code, (c) infringe or violate the rights of others, (d) deploy the Service in high-risk environments requiring fail-safe performance, or (e) use outputs for deceptive, discriminatory, or harmful purposes. We may suspend or revoke access for violations.
"Customer Content" means any data, messages, instructions, media, profile information, prompts, or other materials you or your authorized users provide to the Service. You retain ownership of Customer Content. You grant Thinkify a worldwide, non-exclusive, royalty-free license to host, store, analyze, and process Customer Content solely to provide, secure, and improve the Service, comply with law, and enforce these Terms.
You represent and warrant that you have all rights necessary to submit Customer Content, that the content is accurate and lawful, and that processing by the Service will not violate any third-party rights. We are not obligated to monitor Customer Content but may remove or disable access to content we reasonably believe violates these Terms or applicable law.
The Service uses machine learning models, embeddings, and generative AI provided by Thinkify and third-party vendors. AI outputs can be inaccurate, offensive, or inconsistent. The Service may include automated sending based on your configuration. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING, APPROVING, AND CONTROLLING ALL COMMUNICATIONS SENT USING THE SERVICE.
THINKIFY DOES NOT GUARANTEE THE ACCURACY, RELIABILITY, LEGALITY, OR APPROPRIATENESS OF AI-GENERATED CONTENT AND DISCLAIMS ALL LIABILITY ARISING FROM YOUR RELIANCE ON OR USE OF SUCH CONTENT. YOU UNDERSTAND THAT RESPONSES MAY NOT REFLECT HUMAN INTENT, AND YOU AGREE TO MITIGATE RISKS THROUGH HUMAN REVIEW, POLICY GUARDS, AND SAFEGUARDS APPROPRIATE FOR YOUR ORGANIZATION.
The Service depends on APIs and services from Meta, TikTok, X/Twitter, Supabase, OpenAI, payment processors, and other providers. Use of those services is subject to their own terms and privacy policies. We do not control third-party availability, data handling, or security practices. Integrations may change, degrade, or cease without notice, and such changes do not constitute a breach by Thinkify.
You are responsible for maintaining active platform accounts, complying with platform-specific requirements, and keeping your integrations authorized. We are not liable for downtime, data loss, or other issues caused by third-party systems.
Access to certain features requires a paid subscription or usage-based fees. Pricing, plan details, and renewal terms are described at the point of purchase. Unless stated otherwise, fees are billed in advance, non-cancelable, and non-refundable. You authorize Thinkify or our payment processors to automatically charge applicable fees using your provided payment method.
We may change pricing or introduce new charges with at least 30 days advance notice to the email associated with your account or through in-product notifications.
Our data collection and use practices are described in the Privacy Policy, which is incorporated into these Terms. We implement safeguards designed to protect Customer Content; however, no system is completely secure. You are responsible for configuring account-level security controls (including role-based access, approval workflows, and multi-factor authentication) suitable for your needs.
We aim for high availability but do not guarantee uninterrupted access. Maintenance, security updates, or platform dependencies may cause delays or downtime. We may modify or discontinue the Service (including any feature or functionality) with reasonable notice when practicable. We are not liable for changes required by external platform policies or legal requirements.
Beta or experimental features are provided "as is" and may be disabled, throttled, or removed without prior notice.
The Service, including software, algorithms, interfaces, designs, documentation, and branding, is owned by Thinkify or our licensors and is protected by intellectual property laws. Except for the limited rights expressly granted to you in these Terms, no other rights are granted. You may not copy, modify, distribute, or create derived works based on the Service.
You grant us the right to use your name, logo, and marks to identify you as a customer, unless you opt out in writing. We will seek your consent before issuing press releases or case studies that reference you.
If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback without restriction or obligation to you. Feedback is not considered your confidential information.
THE SERVICE, INCLUDING ALL CONTENT, AI MODELS, ANALYTICS, AND BETA FEATURES, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND AVAILABILITY. WE DO NOT WARRANT THAT USE OF THE SERVICE WILL INCREASE ENGAGEMENT, SALES, OR OTHER BUSINESS RESULTS.
You acknowledge that (a) AI outputs may include inaccuracies, hallucinations, or inappropriate content, (b) the Service is not a substitute for professional advice, crisis communications, compliance review, or human judgment, and (c) you assume all risk for decisions made based on outputs or analytics from the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THINKIFY AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100). THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless Thinkify, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) Customer Content, (b) your use of the Service, (c) breach of these Terms, or (d) violation of any law or third-party right. We may assume exclusive control of the defense of any matter subject to indemnification, and you agree to cooperate with our defense.
These Terms remain in effect so long as you access or use the Service. You may terminate your account at any time through in-product settings or by contacting us. We may suspend or terminate access immediately if you violate these Terms, create security risks, fail to pay amounts due, or if required by law or platform policies.
Upon termination, your access to the Service will cease. We may retain or delete Customer Content in accordance with our Privacy Policy and legal obligations. Sections that by their nature should survive termination will do so, including Sections 5 through 18.
These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before filing a formal claim, the parties agree to attempt in good faith to resolve any dispute by providing written notice and allowing 30 days for informal resolution. If unresolved, disputes (excluding claims for injunctive or equitable relief) shall be finally settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will take place in Wilmington, Delaware, unless we agree otherwise, and the language will be English.
CLASS ACTION WAIVER: DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
These Terms constitute the entire agreement between you and Thinkify regarding the Service and supersede any prior or contemporaneous agreements on the subject matter.
